Pressing Charges

A year ago a company signed a waiver stating they owned the trademark for a an apparel company which I own the tradmark for. I have since settled with the store. The vendor who sold the shirts to the store refuses to talk to me or respond to letter. They sold the store over 9000 shirts. My question because they stated in a waiver to the store that they owned the trademark (word mark) can I go to the district attorney of their state and press charges. Since they lied outright on this waiver. If anyone knows an attorney who handles cases on contingency please pass it on thanks.
