: : I already have the patent. : I also have evidence that a fortune 100 company could be infringing upon it (based upon past and present technical publications; I don't know what a judge would think infringement is, thus the term "could"). : So.. the next question: : Assuming that I can get a contingency deal going with either a law firm or a group that invests in infringement cases (a big assumption, I know) what sort of percentages are the norm for pre litigation settlement vs litigation type cases (is the contengency percentage less if a less costly licensing agreement can be arrived at)? : Thanks in advance. Dear Jim T, It has been done and can be done but it is not the patent that counts. It is the patent claim. It is easy to spend a forutne to get a patent but not usually easy to get a patent that can't be legally avoided. There is a $100M+ a year scam getting patents. One in 10K make more than they pay. Even using a Registered Patent Lawyer is no guaranty that you are going to get a patent that will give you the protection that you need. That is why I push the Reality Check (sm) and Elaine's Workshop (sm). M. Arthur Auslander
