Sometimes the two companies discussed ideas before I sculpted and molded and manufactured them. Now the other company has since found that we weren't selling exclusively to them. They have filed a lawsuit claiming we are infringeing on their intellectual property and have no right to do so. There were no contracts signed by us and ultimately the design came from my mind. Is there any validity to the other company's claim? Dear Brandon, On the basis of what you have said, there does not seem to be any basis to sue. If the suit is in the Federal Court, and the simple facts are as you have said, you may be able to recover your attorneys fees. Don't default. It may be unwise to put further details on the net. M.
