(US FEDERAL COURTS) The makers of "Barney" extracted a comment over the phone from me back in Feb of 1995. They claim I said I could offer live performances of "Barney the Dinosaur" but I never said that. They filed their complaint and summons for this matter March 3, 1998, which is over 3 years from the alleged infringing comment. Isn't that too late to take action? Thanks for your help! (I am defending myself--I don't have any money for a Lawyer. I have looked into it and can't find anyone who will touch this for less than 10 grand.) Dear Chris, I'd have to look it up. There may be a variety of claims with different dates. If you make a motion to dismiss on the ground of the time, you will get a fast answer from the other side and the judge. My gut says you are in trouble. ELAINE's Workshop says E arly L egal A dvice I s N ot E xpensive. M. Arthur Auslander
