As you said, assuming that your idea is not illegal (for example, a judge may believe that the main purpose of your pipe is to smoke marijuana and not tobacco), then yes your idea is copyrightable if nobody has done what you are doing. If someone else already has such pipes, then you may be liable for copyright infringement. Also, you will most likely be liable for both trademark/copyright infringement for the brand names on your pipes if you don't work out a deal with their respective owners. For all other concerns, I would contact an intellectual property attorney. Good Luck, : I am looking to start a business manufacturing water pipes for the tobacco industry which are made out of liquor bottles with all specific brand indentifying labels intact. I was trying to find out whether or not this would be in any violation of copyright or trademark laws. Would I need permission from such companies to use their bottles or have to pay them a royalty? Also under the assumption that this is not in any way breaking any laws, is this idea or product able to be copyrighted/trademarked? Any information you can lend on this topic would be greatly appreciated.
