descriptive names[ Follow Ups ] [ Post Followup ] [ Trademark Forum ] [ FAQ ] Posted by steve on July 23, 2002 at 05:28:33:
I'm getting mixed messages about the name of a product not being too descriptive in a trademark. Let's say my product is a car wax and I (ripping off Karate Kid) want to call it WaxOn/WaxOff. Is it now precluded from becoming a trademark because the name describes what it does? Or fake nails you pound onto your fingers with a hammer-shaped applicator called NailOns? (I'm throwing out those two great ideas to anyone who wants them.) Can those be trademarks?
