If I notice an idea in another country for a product improvement and they do not have a patent, can I patent the idea in my country? Can I patent the idea in my country if they do have a patent in their country? What I would like to do is to sell the product in the U.S., but would like some protection from competitors while I am branding the product in the U.S. I saw some information on Industrial Design that said you had to apply per state. Is that what I should pursue? Any advice you could give me would be greatly appreciated.
