I've been procuring software patents for more than 12 years. Some of my clients include Sun Microsystems, Liquid Audio (portfolio bought by MSFT -- and a patent under litigation slashdotted), Vxtreme (whole company bought by MSFT), and many others. The bulk of my work in the last 6 years has pertained to software in the context of e-commerce.

I am also familiar with Linux (writing this from mozilla in Mandrake 8.2 -- yes, I need to upgrade! -- right now). I write bash scripts. And I use (and love) open source software. I am very sympathetic to open source and hope it survives and thrives.

Feel free to contact me privately if you have more questions.

Regards.

: I'm the editor in chief of LinuxWorld Magazine. I'm looking for someone who may be interested in writing an article on software patents from the perspective of Open Source software development.

: Specifically, I'm hoping to find someone to write an article providing advice for the individual software developers and the people who run open source projects to help them stay out of patent lawsuits.

: I'm imagining this may cover things like:

: - What is a software patent (SP)?
: - What is the state of SP's in America today?
: - What should the agreement betweeen the individual developers and the 'project' be?
: - What can be done with open source software licensing to provide protection to the group and individual developers
: - what is 'prior art' and how can it be demonstrated
: - what corporate form should the group take to provide the most protection
: - what about the 'volunteer protection act'?
: - If the developers are not American, but the group is - does that matter?
: - Should these groups be incorporated outside of America? The teams are generally international in nature anyway.

: or some sub-/super-set of this.

: Our distribution is 40K+ issues targetted toward business decision makers. The author would receive by-line and their picture in the periodical. If the author can make available a variety of photos of themselves we can make the article really look professional -- our graphics people are fantastic. Reprints are available as well.

: This area of law I believe is on the verge of growing -- based on the SCO lawsuit and the patent legislation currently being approved in the EU.

: Please send a short e-mail with your background to myself:
