Anyone can take the bar exam (agent or no), and each year less than 10 try, and zip to 2 pass. My guess is those who do find it hard to get jobs in firms and open up their own shops. A common route is to work as a Scientific Advisor in a law firm, take the patent exam to become a Patent Agent, and later go to law school part time to become a full Patent Attorney. : The Separation of Powers clause in the Fed Constitution gives each state the right to regulate its respective bar. Is there such a thing? What does it have to do with state regulation of the bar (maybe a federalism issue).
