: I'm like most people--I have a wonderful invention and I don't have the $$ to patent it. I'd like to find a company that will buy my idea. I would like to show it to possible customers after they have signed a Non Disclosure Agreement, and if they like the product they could buy my idea and patent and market it themselves.

: Would it be better for me to make a few of these items and sell them to show that they are indeed marketable?

: If I did produce and sell these items, would it infringe on the ability to get a patent?

: If I produced and sold these items, and my idea was taken and patented by someone else, would I still be able to produce and market these items?

Dear Mary,

Knowing what you can do or can't do or how to do is inexpensive. We call it a Reality CheckŪ. Note the trademark registration has just issued. Even a patent might not give the protection that you need.

It is usually prudent to keep the idea secret as long as possible. Commercialization with a trademark might be one route. Patents, even if good only last for 20 years from the date of fileing. Trademarks are good forever, as long as they are in use.
