: HELP! I know this is a very old case (US Court of Appeals. Eighth Circuit, 1966. 360 F.2d 977), but it is also a very important one defining what constitutes a "patent" under US patent law. I have to research it for one of my classes, and am having no luck finding anything about it on the internet. Can anyone help? It deals with the German Gebrauchsmuster and is in regards to patents filed in both the US and Germany during the years 1953 and 1954. The Gebrauchmuster is # 1,660,844 and the US Patent # is '830. Thanks for any and all information. Please email me or post a follow-up!
Is the problellm that you don't want to go to the library to find the case or that you can't get into the law library. A quick reading of the case seems to hold that the US case was filed too late and was invalid under the statute. If you have any other questions emaill me and I'll give my a quick reading of what I see.
