You have asked enough to get a treatise in response and what you have said can't be clearly answered particularly without detailed legal and factual analysis.
There seem to be red flags of danger, small chance of being caught and limits on enforceability, at this point.
It's stuff like this that makes lawyers hated and rich. Once caught in a matter like this it could be expensive even if there is no liability. The law itself is like a hologram, depending where you stand.
