Acronym in same class but different industry
« on: 07-03-17 at 03:09 am »

Hello
I have a word mark already registered  for my company under its full name. However I want to use a 3 letter acronym as part of my logo for the design mark and not the company's full name. The reason for this is space limitation for hem tags and patches on my apparel. My company "XYZ Apparel" is purely an apparel and fitness goods company registered under class 25 and 28. Another company who is a software company "XYZ Software"  has already trademarked a design mark with the same acronym under appropriate classes but for some reason they also included class 25 Namely shirts and hats in their design mark trademark. The specimen that they provided is a polo shirt with their logo photoshopped on it and definitely not for retail sale (no hang tags etc.). They are definitely not a sports apparel and equipment company and in researching their company they are purely a software company.

Is there a possibility that my application will be rejected?

Thanks
