The European Court issued a decision in the case of Deutsche Bahn v OHIM concerning registration as a combination of gray and red as European mark in Class 39 - Transport of passengers and goods by rail.
According to the decision of the court the combination of both colors in the trademark does not help that it be considered distinctive as these colors are widely used for services related to railways..................
