Of course, applying this guidance to particular claim language can be tricky. But there are a ton of examples taken from case law, which should help.

The old MPEP was vague enough about "sufficient structure" that it could lead to confusion with things like "lever means for..." Case law is nice, but it's good to have representative examples added to the MPEP where they're easy to find.

I'm in a more mechanical art, and I like the clarification with regards to when 112 6th is invoked. I see a lot of "structure means for doing X" language in the claims I get.

I often see claims drafted along the lines of:

"A contraption comprising at least one widget and at least one gizmo..."

What is the advantage of phrasing the claim in such a way instead of just saying

"A contraption comprising a widget and a gizmo..."?

About three weeks ago, I interviewed with an SPE. Interview went very well, and I received an e-mail the day after with a request to submit OF-306 form and transcripts.

That's surprising to me bc I thought you're almost a sure thing after the OF-306. Is there anyone out there who got an OF-306 and wasn't offered a job?

Satellite 'offices' plural? Are there other offices other than Detroit in plan for opening?

With House proposing a 5 year salary freeze on gov workers and 1 to 2 hiring-to-dismissal ratio for government, I am not sure what hiring activity USPTO will have in the future.

I wouldn't read too much into that. There's still an immense backlog, and the PTO is looking into expanding what with the satellite offices and all. Plus, if the economy perks up, filings will increase as will turnover.

More salary freezes seem likely, though imo.

I don't buy the argument that all automation is obvious.  Show me an automatic shoe-lace tier -- doing the same knot most people do manually.

Reminds me of Patent #6826983 for an automated light bulb changer.

Look on Craigslist. And then look for reviews online of the places... I know some people will always have issues with any place they live....but I'd worry most about crime and then bugs/rodents.

I was hoping I could avoid Craigslist...I've had some pretty horrible apartment hunting experiences in NYC.  The only review site I really trust is Yelp, and they don't have much on apartment complexes.  Apartmentratings.com looks like a site trolled by management companies.  I don't know what to believe there.

This is purely anecdotal, but I had good luck finding an apartment with Craigslist.

Does anyone know how/if the federal employees 2 year salary freeze will apply to the USPTO?  Under the freeze, I wonder if the accelerated promotion for GS-9's will be allowed?

Afaik the freeze doesn't affect promotions/bonuses, only cost-of-living salary raises. If you qualify for a promotion, you will still be eligible.

I was offered step 5 (GS-9)...with a Ph.D.

Standard. I have a chem Ph. D and was hired as GS-9 step 5, then got promoted to GS-11 step 3.

I don't believe it is like that in the EE/CE/CS arts. Almost everyone I know in those areas was hired at a GS-9 step 8 or above.

True. You EE/CS guys went out and got useful, high-demand degrees, so you get the extra cash.

I am interested in becoming an examiner.

I am a patent attorney with a small practice. I know that 309 MPEP restricts USPTO employees from prosecuting patents while they are examiners, is there anything prohibiting them from consulting work, providing non-infringement opinions?

Even if the parties are aware that this should not be an endorsement of the USPTO? My guess is that this is prohibited, I was just wondering what prohibits this.

Also consider: would it be ok to provide legal IP work for a company for which I am an equity partner?

Assume all of these circumstances are with issued patents for which I would have no involvement with at the PTO, so no conflicts.

I think there are still pretty serious conflict-of-interest issues with this kind of thing even if the patents have issued. IIRC, the PTO has an ethics office that can tell you more. I think you can probably google them.

I am just curious. I looked up the OF-306 and HSPD-12. Does anyone know if these forms, in some way, mean you will be offered a position? I guess a better question is, how likely is it you will not to be offered the position after this step in the process?

My understanding is that it's almost a sure thing that they'll offer you a job if they've sent the OF-306 forms.
