I'm hoping someone can answer my questions with relative ease. I operate a local business in CO that I started over a year ago. When I started my business I registered the name in my State and checked trademarks. There were none.
Today I received an email from a company in CA claiming to own the trademark one word in the company name. I searched the trademark database and discovered two listings, both of which are "dead" as of 2005 and 2006. No "live" listing came up, and both of the dead ones were for businesses other than this company.
Is it possible that she has recently submitted an application and that's why I don't see it? If she does organization work in California and I do Concierge work (including organizing and other things like cleaning and errand running), is this still an issue? Is it better for me to get an attorney and go through the trademark process myself, or approach her to provide proof of trademark first? I'm totally unfamiliar with this process, and am not sure what the proper step is to take to protect myself and my company name.
