Filing pro se when there are co-inventors
« on: 08-24-08 at 03:24 pm »

Hi. An inventor who is not a practitioner registered with the USPTO can file an application pro se.  Does anyone know whether this is permitted if there are co-inventors?  That is, is "pro se" restricted to a single inventor filing on his own behalf, or can he file on behalf of himself and his co-inventors as well?  Thanks.

Off the top of my head (at 10:30 p.m.), I seem to recal they have to all sign.

Hi Bill.  Let me re-phrase the question.  A sole inventor can file an application on behalf of himself.  Can co-inventors jointly file an application on behalf of themselves?  Thanks.

I believe the answer is yes, provided that the other inventors sign a statement; the PTO has authority to grant such limited representation of others before the PTO by non-practitioners.   I'm going by memory from 15 years ago, but am highly confident this is correct.
