Which is Which?
« on: 05-19-08 at 09:24 am »

According to the USPTO there are 6 types of patents:
http://www.uspto.gov/go/taf/patdesc.htm

This forum even lists a forum section/area called "Improvement Patents" yet this is not listed as one of the 6 types of patents.

  • How does a Utility Patent differer from a Design Patent? Examples please.

  • Where would a(n) "Improvement Patent" fall under the USPTO list?

  • If product X has been granted a patent but I would like to improve upon it with a function, what type of patent would this fall under?

Thank you for your postings and responeses

Read the link carefully.  It talks about "types of patent documents".  Note the three types of patents, utility, design, and plant.  Note where improvements occurs.  There is no improvement patent.  It's an improvement over an existing patent and it's still a patent in its own right.  Gotta learn to read like a lawyer.

So can you give examples of a utility patent versus a design patent?

Also, suggest you invest $50 in "Patent It Yourself" by Pressman.  Published by Nolo Press.
