ALTERNATIVE LIMITATIONS IN CLAIMS

Alternative limitations are referred to in 2173.05 (h) of the MPEP.

It says “one acceptable form” of alternative expression is referred to as Markush Groups.  Since it refers to “one acceptable form”, I presume there are other acceptable forms of alternative limitations that can be used in writing claims.

Is the use of “or” an acceptable alternative expression in a claim?  For example if a portion of a claim is phrased as, “wherein the first and second regions are respectively gold and silver or silver and gold, respectively”.

wherein the first region is gold and the second region is silver, or wherein the first region is silver and the section region is gold.

wherein the first region and the second region are independently gold or silver, with the proviso that the first region and the second region are not the same.

wherein the first region and the second region are independently selected from gold and silver, with the proviso that the first region and the second region are different.

wherein the first region is gold or silver, and the second region is gold or silver, and further wherein the first region and the second region are different.

wherein the first region is selected from the group consisting of gold and silver, and the second region is selected from the group consisting of gold and silver, with the proviso that if the first region is gold, the second region is silver, and if the first region is silver, the second region is gold.

etc.
