Please help - Copyright issue

Two years ago, I helped my brother write text for his website which he and his former partner used for an online business.  Fomat and code was created by a third party.  About a year ago, I started a competing business and used the same format (changed in Dreamweaver) and most of the text from the original web site with my brother's permission.  Additionally, any changes I made to my site I helped my brother make to his as well since he didn't know html.  My brother registered and owned the site which he and his former partner used for their business.  To make a long story short, part of a lawsuit filed says that I copied the original website which was copyrighted by the company.  Question is, if my brother is the owner and I helped create the original site along with making all changes to the exisiting site with his permission, does this primarily become a question of who owns the site or did I infringe upon the company copyright?  They didn't register anything with the copyright office until 2004 but they say the first use was in 2002 before I created my site.
