Dear Mr. Whewell,

Are you trying to say that JUST getting a patent should be encouraged? There is a $100,000,000 a year industry doing that, and only one in ten thousand get back more than they pay.

This does not seem right to me whether it is an invention company or a registered practicioner. Not all of Lemelsons patents made money be what he created was good and valuable not aimless trash and it was a question of getting a procduct to market.

There are some inventions that are obviously patentable with OBVIOUSLY avoidable claims, would you encourage an inventor to file such an application if he was not trying to protect an existing business that he was in.

I look at an invention in terms of the inventors rights. Sucess cannot be guaranteed but failure can be obvious with many inventions, with or without a patent.

I'm not trying to say anything that wasn't contained in my earlier message.   I think it is apparent to most that those who take risks are more likely to be rewarded than those who don't.  

I'd be interested in learning more about how to determine that an invention is, as you say, "obviously patentable", prior to filing a patent application.

Dear Mr. Whewell,

One must go beyond the letter of the law to understand whether or not to patent and understand the risks.

Years ago a client had a wonderful invention for an automobile. He discovered that at that time the car manufacturers would not consider ANYTHING that went beyond their minimun cost of the BASIC car, which was unbelievably low.
