Trademark Infringement by Major Corp.
« on: 08-14-07 at 06:27 pm »

While working at an ad agency a few years ago, I presented a talk show forum idea--which was my idea that was trademarked before I began working at the agency.  I presented it to the client who, at the time, decided to not move forward with the project.  They were well aware of the trademark and all documentation indicates the trademark.  The agency, too, knew of its trademark status.

After a successful reign with the agency, I moved on a year later.

Earlier this year, I reached out to senior level executives  at the corporation to remind them of the program which was available through my firm.  They declined.

NOW, however, the corporation via the same agency where I worked are launching a national talk forum targeting the SAME audience as my program which has had active participants over the years.  It contains the same national tour component and other similiar elements.

Is something like this considered trademark infringement?  What can I do?

Thanks.

I am not an attorney but I think this should be posted on the Copyright Forum.  Based on what you've posted, I don't see anything related to trademarks, but you have raised issues of copyright protection and ownership.  I hope this helps.  Thanks.

I'm not sure copyright is even implicated.  Copyright doesn't protect "talk show forum ideas" (nor does trademark, for that matter, so the OP is likely wrong that "my idea . . . was trademarked").

Of course, we might be missing some important facts here, and I encourage the OP to speak directly with an attorney if he thinks his IP has been misappropriated.
