design AND multi-utility patents in 1?
« on: 07-26-07 at 03:35 pm »

Hi, I have came up with a invention that needs a design patent, and many utility patents for different aspects of the thing. Like what would I do?
thanks

Well, you can file a design patent application for the part(s) that need that and file a utility patent application for each of the various aspects that require that.  Seems like a straightforward question; perhaps I'm missing something.

Regards.

Like I ment can you pay a 1 time patent filing fee for...
-the design patent
-the multi utility patents (like 5-10 of them)

and have it all in 1 patent application instead of like 11 different applications

Sorry, it doesn't work that way.  You'll have to at least file a design application (and pay that fee) and at least one utility application (and pay that fee).  And . . . if you have multiple inventions, even if you group them all together in one application, you'll most certainly get a restriction and have to break it into multiple applications.  And . . . if you paid extra fees for extra claims, it will have been wasted because you'll have to pay for an entire new filing (or multiple filings) after the restriction.
