I don't have a case, but I did recently get a letter from a lawyer asking me to change some wording on a website that I have.  It's no biggy.  But I was wondering about some other stuff.

The most intesting thing is that I got the notice from the parent company of Duncan Yo-Yos who famously lost their trademark on the word "Yo-Yo".  Neat.

But I'm wondering how specific a trademark is.  If one company has a trademark on a term like "counterweight" could you circumvent that by adding a hypen like "counter-weight"?

It's too bad I can't post a link, but I've blogged all about this at my website.... which I can post a link to... but it's probably my username with the dot commerce after it.  Weird restriction.

No, that would not avoid infringement.  The test is absolutely not whether the marks are identical, but whether the use of one would likely cause confusion with the other.
