IP rights of TM
« on: 02-15-07 at 09:22 am »

I am a student and currently is working on assignment about IP rights.

I am a bit confuse with the IP rights of TM...  ???
is it correct that TM has only one major purpose - exclusive rights to prevent all third parties not having consent from using the trade identical or similar signs for goods that may cause confusion??  :-/

If so, how about geographic indications? it seems both are containing same objective.  Besides, if there are any other IP rights of TM??  :-[

Could anyone help on this?

Thanks a lot!!

Generally speaking, trademark rights prevent others from using a TM owner's mark in a manner likely to cause confusion.  In other words, where Company A has a trademark, Company B cannot use a mark that would likely cause confusion between it and Company A.
