Author Topic: PTO948 - Views not labeled separately or properly.  (Read 855 times)

I recently received Notification of Allowance for my patent.  However, also included was a PTO948 Item 6 VIEWS indicating "Views not labeled separately or properly."

The drawing reviewer included a copy of 37 CFR 1.85 that says in part, " New corrected drawings must be filed with the changes incorporated therein. Identifying indicia, if provided, should include the title of the invention, inventor's name, and application number. If this information is provided, it must be placed on the front of each sheet and centered within the top margin."

My patent has only one drawing that was originally submit within the patent filing.  At the time of original filing the drawing was 'accepted', but did not have the invention title, inventor, or application number in the margin.

Can I assume that all that is necessary to resolve this is to resubmit the original drawing with the information mentioned above included in the page margin?

I called the reviewer's phone number several days ago, but have not received a call back yet.

Any input is very much appreciated.

Thank you,
Stephen Taylor

Placing the identifying indicia (application serial no., applicant, etc) on a new version of your figure is optional (but good to include) and just adding that identification indicia with no other changes to the figure will not satisfy the requirements of the Notice. You will just get another Notice with a 1-month response period and that will be your last chance to correct the figure.

I also recently received a similar notice and had questions for the draftsperson. After a few days of no returned phone calls, a person at the Office of Patent Publications told me that the draft people were recently laid off. However, this person was able to answer my questions.

I suggest you call the Office of Patent Publications, they ought to be able to help determine what exactly needs to be updated, if any.
