Is this Copyright infringement?
« on: 08-14-04 at 03:31 pm »

Hi all.

Is this infringement of copyright?

-- Scenario --
A website owner asked for some unique code and graphics for their website, this was in collaboration with a group of other authors, each submitting their own code and graphics for separate web pages within the website.
The work was submitted to the website owner on condition that the author retains the copyright but the website owner can use the code and graphics.
The author was not paid for the work and was told they will be paid when, and if, the website was successful in making money.
There was no written contract, only what was said in an Internet conference on-line.
After finding out that the website owner had made it quite intolerable to work with them, the author decides that his work should be removed from the said website.  The website owner refuses to do so and said, in their closing remark, that the author should get an attorney.
-- End of Scenario --

This is primarily a contract dispute and I cannot predict
the winner without knowing what was said or done.  If the
author is a winner on the contract issue, then the web site
owner may be a copyright infringer.
