Is this a "new use" patent?
« on: 10-25-06 at 01:49 pm »

I'll caveat this by saying that I read a few "diy" patent books last year (just enough to make me dangerous) but it's been awhile, so just thought I would check here and see if someone could answer my questions.

I have an idea for a product. . .my story goes something like this (some of the facts have been changed slightly). . .

I'm familiar with recycled road tire material and all of the various uses for it.  I own an e-commerce store that already sells a lot of non-innovative products made from this recycled material.  I thought of a new product made from recycled tires -  bracelets.  Can I patent this product idea?  I actually went ahead and had the bracelets made by one of our suppliers and now have them in stock sitting beside me (just got them today).  I'm ready to start marketing the heck out of them but am a little worried that it could be a big hit and 10 years from now I'll say "If only I had done my patent research first. . ."

Is my idea patentable and, if so, isn't there something I should maybe fill out and mail "just to be on the safe side" before I sell one (I thought I remembered reading some rule about filing before you start selling the product?).

Thanks in advance!
