School District - Trademarking Name, Mascot, Logo
« on: 10-17-06 at 03:25 pm »

I am going to be trademarking the names of our school district's high school.  Additionally, I will like to trademark the mascot names.  What is the best way to trademark the mascot name?  The mascot name by itself? The mascot name with the high school name in front of it?  Or the mascot name with the town (minus High School) infront of it?   Would one way protect all uses of the mascot name?

Example: Chicago High School Cougars; or Chicago Cougars; or Cougars

Any info would be very helpful!

First and foremost, one does not "trademark" anything.  If something is distinctive and is used as a trademark, then it is a trademark.  If not, it isn't.

Second, if you'd like to seek registration of a mark (what many call "trademarking"), you need to register the mark as it is used.  There are limited selections to make in some instances regarding what to include and what to leave out, but that doesn't mean you choose what to "trademark".

Finally, I'm not sure what you mean by the "mascot", but if that's different from the team/highschool name, then you might not have a qualified trademark use there.

I too am interested in figuring out how to trademark our school district's name.  Our district's com&org domain names (DISTRICTNAMEschools com and DISTRICTNAMEschools org) are both presently parked by HighSchools com.  We are the only district in the nation with this distinctive DISTRICTNAME.

Since 1999 Public Schools are no longer able to register .edu domain names, as they are reserved for colleges and universities.

Is it worth the energy to go after this domain name or should we just stick with DISTRICTNAME k12 oh us?  (Which is way too long and confusing in my mind.)
