Foreign Absolute Novelty
« on: 10-13-06 at 03:58 am »

I know that activities that, in the US, trigger the one-year grace period (102(b)-type), bar application in most (all?) foreign countries.  (E.g., on-sale (has to be in US), public use (has to be in US), publication (can be foreign).)  Can someone point me to the substantive law anywhere?  I'm particularly interested in:  JP (six-month grace?), DE, CN, and UK.
Thanks!

For DE and countries in the EU, this is governed by the European Patent Convention, articles 54 and 56.

Absolute novelty has been adopted for European patent law, and everything that has been made available to the public in any way before the date of filing , anywhere in the world, is no longer regarded as new.
