positive limiation vs negative limiation again
« on: 10-03-06 at 12:21 pm »

Hi, the discussion of the previous thread is very information... I have a question that is related to that thread...

if in a prior art, the design has A + B+ C + D

now a new patent looks like this: A + H + K + F,

the desired patent claim is to have A and H in the first claim, and H is an improvement of B, and the improvement made by H makes C and D redundant ...

what would be the best way to write the independent claim containing A and H... using a combination of positive or negative claims??

Without seeing the actual claims, it's hard to say.  I generally avoid negative claim language, but I have used it on occasion.
