Hi

I am new to this great site. I have been Electrical Engineer in Silicon Valley caught in current downturn, and am planning transition to patent agent career. I have been preparing from 2004 PRG material, and will supplement with recent Bullseye material (just purchased). I also did some practice exams (2002, 2003) with catprep simulator.  I have few questions:

1. Can one go back to "previous question" in actual patent bar exam and make changes in previous question (with catprep many times when I went back, previous answer was gone or wasn't at correct selection). That made me concerned, and I started going back each time to double check. On multiple occasions, I had to correct previous answer. I am assuming this is something in catprep software and won't be issue in real exam, Please give your comments?
2. While MPEP tab was there in catprep, but there was no MPEP to be opened (except search for word could be done and it will tell you corresponding pages in MPEP). I instead worked with separate MPEP pdf file, and did use find/find-again with adobe 5.0 version on my computer. Is there a test one can buy which would emulate real online test with real MPEP experience etc?

I hope 2004 PRG material is OK to prepare. Also, can one take blank paper for scratch work on real exam?

1. Yes you can go back and answer questions on the real one and yes it will store the answer.
2.  Yes, you will get an Adobe-like Reader to do Find-Next on the MPEP.

Hi.  Long time lurker who passed the test last week wed.  Was definitely harder than I thought it was going to be.

Had about 8 or 9 questions on PCT: mostly, what if you enter the national stage without a translation right at the 30 mo deadline, what if you enter the national stage without a specific declaration that you want the app to be a national app claiming the benefit of the pct (what is your filing date, and is it a national app or a reg nonprov)

I had a bunch of questions on reissue (like 6)

A lot of questions on appeals (like Cool: a lot on timing.  One on whether you can get extension of time to keep copendency after you file notice of appeal, but without filing an appellate brief.  Question as to what (in months) extensions you can get for brief, reply brief, request for rehearing.

One question on what docs don't need a signature.  Maybe best to just make a chart about this one.

I had 2 on protest: when can you submit and what can you submit (prior art, public use, etc.).

I had a weird question about a patent practitioner conflict of interest - is it triggered when you represent family members of an applicant. 

Another question on does the Office look into claims of inequitable conduct/fraud on the office: answer: no, but if a judge determines there to be inequitable conduct, the patent office can act because it is not THEM who did the investigation, but a judge. 

The rest was pretty standard: claim construction, tribbel, Costa rica, 1.131 & 1.132

I'm studying for the exam and wondered what's a good amount of block time (eg 2, 3, 4 etc hours at a time without a break) to study everyday? I try to do 2 hours without a break for 2 or 3 sessions.

Since the exam consists of two 3-hr sessions, you should study for a minimum of 3 hrs at a shot.  If you can consistently sustain yourself for 3-1/2 hr, you'll have an extra margin of training for test day.  Good luck

Could anybody give me an idea where in MPEP or 37CFR I can find this or develop a chart? Anything would be greatly appreciated.

I would suggest you learn to search the MPEP.  You can access it online from the USPTO site and search it much the same way you would be able to during the test.  You need to learn how to do that if you want to have any chance of passing the test.

I PASSED THE PATENT BAR TODAY. 

The best advice I can give is to keep GOD first, NEVER give up!!  It took me THREE Failures to get it right.  Iam HONEST with myself.  It's funny for an exam to have a 47% pass rate, yet, EVERYONE seems to pass on the first TRY??!!!  Guess What...My registration number is on the way. 

Remember to KNOW HOW TO SEARCH THE MPEP.  I had a total of 52 repeat questions from 02-03 exams.  The other 11 questions I needed I looked up.  I think I scored a 77%. 

Remember to STUDY 700, 1200, 1400, 1800, 2100, 2200

Remember to focus and have faith...IT WILL COME TO "PASS"!!!!

Is there a May 2001 Test? I'm studying using PLI materials and it had a May 2001 test included,but I coulndt find it listed anywhere on the web. In addition, on my previous practice testes(02/03) I scored around 86%, but on this may 2001 test i scored 52%!

It seems like some of the answers are wrong to me...or perhaps just more difficult to grasp.

Hi,  I just started studying for the patent bar.  What is the difference between U.S.C. 102 (a) and U.S.C. 102 (e)?  It seems like (e) is just for when the invention is patented by someone else and that is already is covered in (a).

I have a general question about Prometric test.
Can anybody tell me whether the title of each charpter is shown on the test? For example, the chapter is shown as “Chapter 700 Examination of Applications” or just “Chapter 700″?

They show the title of the chapters on the exam.  It is similar to searching the MPEP online from the USPTO site.
