Trademark Classification Question
« on: 08-23-06 at 10:40 am »

I'm filing a trademark for a unique, unused term. There seems to be a gabillion classifications on the USPTO website and I'm a little confused. Can someone please point me in the right direction? My question is below...

Q: Let's say you have a web-based business (no brick and mortar) and this website business provides a specific type of information. The site is supported by advertising. In addition to the online information -- you will probably have information that could be downloaded in PDF format for a price. Also, you might offer a printed copy mailed to the purchaser.

What classification do you use? I've seen the following that seems generic enough. Is this correct or do you have to be more specific? Thanks so much, please help the confused...

You can describe your services using ordinary terms, and the examiner will suggest appropriate classes.  This approach is less advisable than carefully formulating a proper G&S, but it's workable nonetheless.

As for your hypothetical G&S, the examiner will likely require you to state the field of the information to be provided.

Finally, it bears mentioning that a "unique and unused" mark may still be denied registration for a number of reasons.

Thank you for the reply. I'll make it as specific as possible. Thanks again.

To be clear, I never suggested you should "make it as specific as possible."  What I did say is you should carefully formulate the G&S.
