Author Topic: Should I patent as a group or patent individually?  (Read 659 times)

For example a set of toy soldiers, it includes:
- toy soldier in crawling position
- toy solder in standing position
- toy solder in crouching position
- toy tank
- toy missile launcher

Should I apply for patent as a set that include all 5 (1 patent), or apply individually (5 patents: crawling, standing, crouching, tank, launcher)?

I think my case is similar to this so I hope to hear a reply.

Assuming your set of toy soldiers is patentable, I guess you could have a set of claims that included all those toy components.  But in actuality this question is difficult to answer without considering a number of other factors not present in the hypothetical.
