Trade-mark Paralegals/Clerks - Their Role

Are there any trade-mark paralegals/clerks out there who can comment on the scope of their role in an IP group/law office. What duties fall on your desk?

If you are interested in becoming an agent, what responsibilities should you seek to take on in an effort to bolster your knowledge and prepare for the examination (short of taking the tutorials).

What is a typical job description for a trade-mark paralegal?

Greyday,

Because you are mentioning becoming a trademark agent, I think it safe to assume that you are Canadian.

Unfortunately, in the U.S. only patent agency is available to non-attorneys and that doesn't make me happy.  Frankly, I have been talking about trademark agency to attorneys for about as long as I've been in IP and don't see why the ABA has dug in their heels on this issue.  Since other countries allow trademark agency status, under a stringent testing system, I think it is high time that the ABA get with it and also establish the criteria and testing for agency status here.  Trademark agents have not hurt the earning capacity of attorneys in Canada so it is not a valid rejection point.

I spent more years than I want to mention on this forum in law firms being given a variety of responsibilities, the depth of which usually depended more upon the ego and need for control of the attorney than on my abilities.  Some let me do more, some less, and many of those who had the good sense to ask me to do more became my clients after I finally left law firms behind and open my own paralegal service.  However, I am also starting law school, not necessarily to become an attorney, but definitely to expand my knowledge and abilities by taking research and other classes, as many as I can squeeze in.  If I can graduate with a J.D., fine.  If not, fine.  I still will remain a paralegal either way and keep my paralegal service going, probably with even more employees, and maintain my niche.

Feel free to email me off-list to discuss this more.
