Help needed to complete my Trade-mark application
« on: 08-13-06 at 10:56 am »

Dear Specialists in Trade-mark applications:

I filed an application requesting to register a trademark for my software product. In my original application, under Wares/Marchandises: "Software to help draw wellbore diagrams or schematics, and then to related engineering calculations for oil and gas industries.", and also under services: "Services provided by the company is engineering consulting services with the software, wellfile document management under the aid of the software".

But I received a notice from Canadian Trademark Office asking me to do two things as follows:
1. Applicant to disclaim the right to the exclusive use of XX and YY apart from the trademark.
2. A statement in more specific terms of the services. So a revised application is required.

For the first question, I'd like to write:

The applicant, (my name), disclaims the right to the exclusive use of the words "XX" and "YY" apart from the trade mark.

For the second question which is confusing one for me, what's your suggestion?

Should I delete the services leaving the description for wares/marchandises, as I just want to register a trademark for my software?

Any comment would be greatly appreciated.

Hi Ken,

I am not a lawyer or agent but may be able to point you in the right direction. I believe your statement disclaiming is set up correctly, no problem there.

With regards to your services and wares you may want to consult the Canadian Wares and Services Manual from the CIPO website. It can be found under trade-marks>Publications>Wares and Services Manual.
Find a list of services/wares in the manual that best describes your own.

Quote
The Manual contains a representative listing of acceptable wares and services pursuant to paragraph 30(a), as well as directions for rendering insufficiently specific wares and services acceptable. The listing of wares and services contained in the Manual is not intended to be exhaustive.

I dont think you can just delete your services and wares.
