Using Pro Sports Logo's on a Fan/News website
« on: 07-30-06 at 10:41 am »

My initial thought is that I can't... I'm talking about NFL, NBA, MLB, NHL, NLL, MLS, CFL, etc. Can these logos be used on a fan/news site? What about colors?

Generally, "yes" to colors, "no" to logos.  Practically speaking, if you're not selling anything, you may "get away with" using the logo, even though it's technically illegal.

So if I were to put something like: "The team names, logos and uniform designs are registered trademarks of the teams indicated." at the bottom of each page, I could probably get away with using the logo?  Is it worth asking permission, or just go ahead and use them?  Obviously using the logos over not using them will make the sports news site seem more legit, know what I mean?  But at the same time, I don't want some legal letter from the NFL showing up at my door. ;)

Unfortunately, the devil is in the details here.  It's virtually impossible to give you any substantive guidance without delving into the specifics of what you plan to do.  I'd be happy to go over your plan with you, but I can't do that in the context of this forum.

Sure, that would be great. :)  How can we do that?

Feel free to call me at your convenience.  I'll open a matter for your and we can get started after the formalities are taken care of.

This going to cost me? or free advice? ;)  Does it matter than I'm Canadian?

Remember that you get what you pay for, and regarding Canadian citizenship, it matters only on "South Park."   ;D

The short answer is, yes, I charge for providing legal counsel.  The slightly longer answer is that my practice is devoted in large part to individuals, start-ups and small business, and my billing rates and practices reflect that.

Ok Jeff... I'm just setting myself up as a legit business... so in the meantime, I'll probably not use the logos and I'll be in touch. ;)

I'm here if you need me.  BTW, being Canadian, who's your team?  I'm a Devils guy, but I have clients in Ottawa and Vancouver, both of which are home-team fans.

Hehe... Well, I grew up in Vancouver, so I'm a Canucks fan for sure... though I currently live on the East coast, so I'm bombarded with the Leafs. ;)
