Herrmann v. Otken
« on: 07-17-06 at 02:04 pm »

This is an old (1953) CCPA case that discusses "intellectual domination" for inventorship.  Does anyone know if it's been cited since?  I've seen it referenced once or twice in articles, but not cited in any case.  (OK, I'm too cheap to get WL or L-N.)   :-/

I have not heard of the case you mention.   The MPEP cites Morse v. Porter 155 USPQ 280, 283 (Bd. Pat. Inter. 1965) in discussing the concept.   The MPEP discussion is IMO raises more questions than it answers.
