Trademarking a logo with different sub-parts
« on: 06-23-06 at 08:56 am »

Hello, I would like to trademark my company's logo (a nicely-designed image). The logo has space for a short phrase, and we have picked out several phrases that we like.

Would we have to file for a trademark for each logo+phrase combination, or is there a way to combine all of them into one  filing (one trademark + minor variations). If not, would it be reasonable to just trademark the logo and then put the phrases in surreptitiously later? Or is it better to have full protection over the phrases also?

Mr./Ms. Rafkind,
With something as important as your company's brand,  I would strongly suggest that you not rely solely on the generalities offered in forums such as this and seek out and work with qualified trademark counsel.  A trademark specialist will be able to give you specific advice particular to your company's and brand's needs.  Whatever money you must spend will be well worth the educated advice you receive, especially since good counsel will prevent you from making mistakes and wasting money.  Good luck.

While there is no mechanism for filing multiple marks in a single application, there are filing approaches that provide fairly effective protection for multiple marks under a single registration.  The effectiveness of the approach depends in large part on the similarties between the marks.

In your case, a filing on the underlying graphical elements of the logo would likely go a long way to protecting the various variations of the logo + phrases.  The registration would likely not do much to protect the various phrases themselves, however.
