I have a potential client, an individual, who has received a notice of opposition for his trademark registration. Unfortunately, he has been out of the country and virtually incommunicado. He is filing a motion for an extension of time to answer, but the opposer did not consent and the TTAB will not be able to rule on the motion before the expiration of the time period to answer.

Should I counsel him to scramble to put together an answer (which will probably overlook any possible counter claims and might not be complete), wait for the ruling, or prepare a complete and sufficient answer as soon as possible?

For obvious reasons, I have not agreed to represent him in this, but he is a friend and I'd like to help if I can.

Any comments or suggestions?

Someone should file an answer.  They don't need to say much to be effective.
