Can I teach this subject? Can I use the name?
« on: 06-20-06 at 08:36 pm »

I have a professional medical education company.

There is a medical device made by company Z that is widely and commercially available to anyone that wants to purchase it.

I want to hold education classes, teaching medical professionals how to use this device.  The device is patented, however, the techniques on how to use this device are not patented.  The company that owns the patent also teach classes on how to use this device.

2 questions:

Can I teach classes on how to use the device?

Can I use the name of the device in my advertising and course title?

ie "Basic use of device z"

I strongly suspect that I can, as I see "windows for dummies" books all over the place.

Any advice?

FDA issues aside, there should be nothing in the patent nor trademark laws to prevent you from conducting yourself as described.  You may want to run the specifics by a qualified IP attorney for a formal opinion, just to cover the bases properly.
