Same name, same class, but different product...

Hey everyone!

I have this name that I have picked out and did a search with USPTO site.  I found the same name in the same class, but this same name is "Ladies Shoes" and I will be selling "Clothes" under this name. Can you still trademark a name if it is being used in the same class, but a different product???  I am a little confused!  I would love to use this name if I can.  I could use some advice!  Thanks!!! ;)

Hello, Dezinr

Based on your question, I could give you some information in China panten and trademark office. In China if the trademark have been already registered in the one classe but you also want to use it in the same class. As long as your product or service are not as same as the registred one, that's ok! just as you said, the registered trademark are" ladies shoes" and your product is" clothes" if they didn't registered "clothes" you can application it also. This suggestion is adopt to China.
