Patented: Any Video Interactive Website?!
« on: 05-30-06 at 03:26 pm »

Hi all..

does this patent make it so that any web developer cannot upload, play, rate, and/or discuss videos on the internet?

http://appft1.uspto.gov/netacgi/nph-Parser?Sect1=PTO2&Sect2=HITOFF&p=1&u=%2Fnetahtml%2FPTO%2Fsearch-bool.html&r=1&f=G&l=50&co1=AND&d=PG01&s1=internet&s2=%22video+rating%22&OS=internet+AND+%22video+rating%22&RS=internet+AND+%22video+rating%22

i find it hard to believe it's enforcable, since this technology has been around longer than the patent has.

First, you've cited an application, not an issued patent.  So, it's not a patent.  It's also not enforceable.

Second, I doubt very much it will ever be allowed as it currently stands.  There are just too many vague words in there: "easily", "intuitively", etc.  How are we supposed to know if we infringe?  Is our system "easy"?  Hard to say.  Is our system "intuitive"?  Hard to say.  I suppose it depends on how many angels can dance on the head of a pin.

Even beyond that, there's some specific limitations as to which server does what and where things are re-directed.  So, it's probably not as broad as you fear.

Lastly, I only briefly looked at claim 1.  That's all I can do right now.  If you're really concerned about it, read it carefully.  The claims define what infringes.  Read them carefully.  Read the header information carefully (and you'll see it's just an application, not a patent).

Regards.
