Costs of suit?
« on: 05-30-06 at 02:46 pm »

Can someone advise me of the rough costs and scenarios associated with persuing a court case to protect a trademark in California?  (A lawyer told me it could be anywhere from 20k to 50k, which sounds crazy to me).

THANK YOU.

It's very difficult to prognosticate the cost of a suit.  Much depends on how much discovery and motion practice there might be.  Also, the billing rates and practices of the law firm impact the overall cost significantly.

At my rate ($185/hour) and with my billing practices, many TM infringement cases can be completed for less than $20k, exclusive of any surveys we need to complete.  I'm a sole practitioner that bills conservatively.  A medium to large size firm would easily charge three times what I do.
