want my website name to be a trademark
« on: 05-23-06 at 08:50 am »

I have a registered domain mytrademark.com
How do you think how much it will cost me to register it as a trademark?
My trademark is a succession of several consonants (no vowels) and it doesn't resembles any word in english or, I think, in any other language (although it may be a misspell for an english word. In google results page I see some ads or sponsored links for that word it resembles). It is an abbreviation of an english phrase, first letters taken from that phrase.
When I google for my trademark I don't find any company that uses it as a trademark. Only one company uses it as a shortened name for a sport tournament it presents, the same way as me - as an abbreviation of an english phrase by first letters. But I couldn't see anywhere on their website that this is a trademark.
So I think in my case there will be no need for Trademark Comprehensive Study which is the most expensive part of trademark registration (am I right? is it really the most expensive part of it?). Moreover I have a .com domain name registered with my trademark.
What do you think?

Are you using your domain name to identify the source of goods and services in interstate commerce?  If not then you cannot register the domain name as a trademark.   Just using mytrademark as your domain name is not a trademark usage.

I'm not sure why you conclude that this described usage is not a trademark use.  It certainly sounds like it might be.

I think you may be operating under the misconception that trademarks are created through registration much in the same way domains are registered.  This is false, however.  Trademarks are created through use, and so the company you reference may have trademark rights even if they haven't registered their mark.

Isaac's point is related, and is 100% correct.
