Trademark Conflicts

Hi,

I've applied for a trademark:

"XWidget"

There is a company doing the same services but with just as the name:

"Widget"

My services are more niche, and in their application they go over a broad spectra of services.

The guys doing the trademark services said they are confident I will be successful in getting this mark, however I assumed they'd say that just to earn more...

Has anyone experienced anything similar? Was your application successful?

Mark, it's almost impossible to give any real input on the situation based on a contrive hypothetical.  Trademark law is incredibly fact bound, and so the actual facts of your situation, including the exact names, channels of trades, G&S and the like are critical to assessing the situation.

That said, based on your (very) limited fact pattern, I'd say your "guys doing the trademark" are likely out to lunch.
