non-profit trademark
« on: 04-02-06 at 12:07 pm »

I am part of a new non-profit organization and we have a new logo which includes the name of a for profit corporation, the only difference being that it has the word "foundation" at the end of it.
For example:
The non-profit organization's name is
"XXXX Foundation", and the for profit's organization's name is "XXXX".  My question is that are we allowed to trademark this logo that uses words that are already trademarked?  Will USPTO accept this?
One note, the owner of the "XXXX" corporation gave us permission to use "XXXX" in our logo.

Also, does anyone know if there are any reduced filing fee programs for non-profit organizations?

There are no reduced filing fee programs for non-profits, as the filing fees are already pretty low.

If the owner of the senior mark gave you permission (in writing) to use the mark in yours, then the PTO will allow your registration in almost all cases.
