an image to copywrite?
« on: 03-15-06 at 04:44 pm »

I have designed what I think would make a very cool logo.

How do I get it 'out there?'

Would I need to copywrite it and if so, how?
How do I go about getting a company interested in it?
If someone shows interest, what sort of a deal would be made?

Thanks for any tips.

Hello Sarah.
You do not need a copyright but what you need is a trademark.
Copyrights secure an artist's work while trademarks secure a name or visual logo.
Go to the u.s. trademark office and secure your logo.

Most companies I assume use independent marketing firms for there ads and marketing. I would suggest talking to an independent marketing firm. They might buy your logo or idea.

I want to respond to Berkeley's post just in case any readers come to this thread in the future.  Contrary to his advice, one cannot "go to the u.s. trademark office and secure your logo" under the facts given by the OP.   In order to secure a trademark registration, one must be using the mark in commerce as a trademark.

Under the facts presented by the OP, as I understand them, even an Intent To Use application would not be appropriate, as there's no bona fide intent to use the mark in commerce as a mark.

I am but a private citizen. You are the real thing, jsonnabend. I would always advice seeking legal help. You are right though. Trademarks are a lot different from copyrights. My apologies.
