what to do about lawyer not following up?

A lawyer agreed to work on my patent for free because I had taken a class of his a while ago. I'm at the RCE filing stage of the patent and three months ago he agreed to write up a responce. Since he decided to help me for free I didn't bother to look to pay someone else. A month ago he agreed to send me the revision via e-mail on the due date of the fifth. It is now the 23rd of that same month and I haven't heard anything from him. I've tried to contact him numerous times via e-mail but he never replies and I have tried to contact him by calling him up but he hasn't been in his office for about a week now.

I'm in the second month of the application being late. He has had three months to work on the patent and I have seen nothing in return yet. I wanted to know if I had any options to handle this problem? What can I do? Have I screwed myself over by trusting this guy? I know where to meet him in person to confront him but I don't think that will solve anything at this point.

You can switch attorneys at any point.  

The filing fee for being one month late is about $60 dollars (small entity), but is $225 for the second month, and $510 for the third month.   Maybe a frank discussion with your lawyer about the fees will get you a committment.
