Apartments under same NICE class. as Hotels?
« on: 06-10-04 at 05:05 am »

I own an apartment in the centre of a big city. The Executive Committee of the
apartment building, which is made up of some of the owners, wishes
to change the name of the apartment building.

However, the name they have chosen includes the name of
a very famous 5-star hotel. That hotel has registered their trademarked
name under the NICE classification that covers services providing
temporary accomodation.

As some of the units in my apartment are made available by owners for
rent, does my apartment building possibly run the risk of being in violation of
the famous hotel's trademark?

Many of the Executive Committee argue that this would not be so,
simply because they are changing the name of the building. However,
would such a choice of name pass any confusion test if challenged?
